Terms and Conditions
Last updated: September 13, 2026
These Terms and Conditions ("Terms") govern your access to and use of https://txog.shop (the "Site") and the related content, accounts, products, and services we make available (collectively, the "Services").
The Services are operated by Texas Oil & Gas Collective LLC, a Texas company using the public names TEXAS OIL & GAS and TX OIL & GAS ("Company," "we," "us," or "our"). Our business mailing address is 5900 Balcones Dr, Ste 100, Austin, TX 78731, United States. You can contact us at 832-301-5775 or DRAY@txog.shop.
Please read these Terms before using the Services. Where we request your affirmative agreement, completing that agreement signifies acceptance of the applicable Terms. If you do not agree, do not create an account or place an order. Our Privacy Policy, Shipping & Returns Policy, and Refund & Cancellation Policy explain the related practices and purchase conditions. Acknowledging a privacy notice is not consent to optional marketing or to any other processing that requires separate consent.
1. Eligibility, Age, and Industry-Specific Compliance
The Services are intended only for individuals 21 years of age or older. Individuals under 21 may not register for an account or purchase products through the Services. A parent or guardian cannot authorize an under-21 person to use these age-restricted Services.
TEXAS OIL & GAS offers products that may be subject to federal, state, and local laws and regulations governing hemp-derived products, cannabinoids, age-restricted products, shipping, possession, purchase, and use. TEXAS OIL & GAS products are intended for purchase and use only by individuals 21 years of age or older and are offered only where permitted by applicable law. By accessing or purchasing through the Site, customers represent that they meet all applicable age and eligibility requirements. Customers are responsible for confirming that their purchase, possession, receipt, and use of a product is lawful in their jurisdiction; this does not transfer or eliminate the Company's own legal responsibilities.
TEXAS OIL & GAS may restrict, refuse, cancel, or decline orders, shipments, transactions, or access to products based on age, location, applicable law, shipping restrictions, product eligibility, processor or carrier requirements, or other lawful compliance considerations. Product availability and shipping eligibility may change. Listing a product does not establish that it may lawfully be purchased, received, possessed, or used in every jurisdiction.
Nothing on the Site, including product descriptions or other informational content, is intended as legal or medical advice or to diagnose, treat, cure, or prevent any disease or medical condition. A website age acknowledgement is an initial access control, not a substitute for additional identity, age, location, payment, shipping, or eligibility verification required before a transaction is accepted, processed, or fulfilled.
We may request information reasonably necessary for required verification. If we cannot fulfill an order or cancel a paid order, we will return the payment due under the Refund & Cancellation Policy and applicable law. Compliance review does not authorize indefinite retention of payment for unshipped goods.
2. Our Services
The Services include website information and the account, catalog, preference, and other functions that are actually available. A feature described as coming soon is not an offer of currently available inventory. Features may be modified or restricted for lawful operational, security, or compliance reasons.
Informational shopping tools do not provide medical advice or guarantee an individual outcome. A displayed preference match is not a safety determination, medical assessment, or promise about the effect of a product.
3. Intellectual Property Rights
The website design, text, graphics, photographs, software, databases, and other content owned by or licensed to the Company ("Content") are protected by applicable intellectual-property laws. Third-party trademarks and licensed components remain the property of their respective owners and are subject to their applicable rights and licenses.
Subject to these Terms, you may access the Services and download or print properly accessed Content for personal, non-commercial use or legitimate internal evaluation of our business. Except where applicable law or a separate license permits it, you may not reproduce, sell, license, or commercially exploit Company Content without permission. Requests may be sent to DRAY@txog.shop.
Display of a third-party card-network mark identifies that brand only. It does not establish a sponsorship, endorsement, bank approval, or active payment-processing relationship.
4. User Representations
You represent that information you provide is accurate and current, that you have capacity and authority to agree to these Terms, that you meet the 21+ requirement, and that you will not use the Services unlawfully. You must not impersonate another person or submit false age, payment, identity, or shipping information.
We may request correction of inaccurate information or restrict an account or transaction where a material inaccuracy creates a legitimate security, legal, or fulfillment concern. Any payment already collected remains subject to applicable refund obligations.
5. User Registration and Accounts
Keep your account credentials confidential and notify us promptly of suspected unauthorized access. Do not send passwords or payment-card security codes through ordinary email or customer-support forms.
Account functions may include contact and shipping details, order records, inventory interests, and reorder preferences. Saving a reorder preference or frequency does not authorize an automatic purchase, subscription, or recurring charge. Any future recurring-payment program requires separate disclosures and authorization before charges begin.
Optional inventory or marketing enrollment is not a condition of account creation or purchase. Accounts may be suspended for legitimate security concerns, fraud, unlawful conduct, or material misuse, subject to applicable law.
6. Products and Product Information
We seek to describe products accurately. Images may differ from the appearance on a particular screen, and natural or packaging variations may occur. Such differences do not excuse materially misleading descriptions, shipment of the wrong product, or other failures to provide goods conforming to the order.
Availability is not guaranteed until confirmed for the order. We may correct listing errors or discontinue products. We will not substitute a materially different product or impose a higher price on an existing order without the customer's agreement. If we cannot honor an order, we will notify the customer and handle cancellation and any payment in accordance with applicable law.
7. Purchases and Payment
Prices are stated in U.S. dollars unless clearly identified otherwise. The applicable order total, including disclosed shipping charges and taxes, is presented before an order is submitted. You must be authorized to use the payment method you provide.
Online payment processing is not currently enabled. When enabled, payments will be handled by the applicable third-party processor. Only methods actually made available through the configured payment service can be used. Card-brand artwork displayed for presentation purposes is not an acceptance claim.
Payment providers may maintain payment credentials or tokens according to their own privacy practices. We do not directly store complete card numbers or card security codes in our customer-account metadata.
An automated acknowledgement is not proof of shipment. We may reject or cancel orders for lawful verification, inventory, fraud-prevention, or fulfillment reasons. If we cancel an order after payment is captured, we will refund the amount due; a processor or carrier issue does not permit us to disregard a legally required refund.
8. Shipping, Final Sales, Refunds, and Cancellations
All sales are final. We do not accept returns or exchanges. Refunds are limited to damage supported by proof or nonreceipt confirmed by the carrier or delivery entity, except for refunds and other remedies required by applicable law.
The detailed conditions, evidence process, cancellation rules, and refund timing are in our Refund & Cancellation Policy. Processing and shipping requirements are in our Shipping & Returns Policy. These conditions must be available before purchase.
The final-sale policy does not eliminate rights concerning unshipped orders, legally required delay cancellations, unauthorized charges, recalled or nonconforming goods, or other rights and remedies that cannot lawfully be waived. A delivery-provider confirmation is not required to establish our own failure to ship an order.
9. Inventory Alerts and Communications
Inventory interests and optional communications are voluntary. Saving an interest does not establish that a notification provider is active or that an alert has been sent. We use an active delivery service only when it is available and the necessary permission has been obtained.
You may change interests or withdraw optional marketing permission through available account controls or by contacting us. Necessary account, security, order, or support communications are distinct from optional marketing. A telephone number supplied for an account or order is not consent to marketing texts. Any future SMS program will have the required separate disclosures and enrollment.
10. Prohibited Activities
Do not use the Services to commit fraud, misrepresent age or identity, compromise another account, circumvent lawful access or verification controls, introduce malicious software, interfere with website operation, harass another person, submit unlawful material, or infringe another person's rights. Do not use automation to abuse or overload the Site or collect personal information without authorization.
These restrictions do not prohibit lawful criticism, honest consumer reviews, legally protected activity, or use permitted by an applicable open-source license.
11. Reviews, Feedback, and User Content
Where reviews or other user content are enabled, you retain ownership of what you submit. You grant us a non-exclusive license to host, format, display, and reproduce that content as reasonably necessary to provide the feature. You must have the right to provide the material.
We may remove unlawful, irrelevant, clearly false, infringing, abusive, or privacy-invasive content. We do not prohibit honest negative reviews, penalize customers for lawful criticism, or require transfer of ownership of a review. We do not require a waiver of these rights to obtain a legally required remedy.
12. Privacy and Data
Our Privacy Policy describes information categories, purposes, recipients, retention, and available choices. It is a notice of practices, not a blanket waiver of privacy rights or a substitute for separately required consent.
No system can be guaranteed completely secure. Protect your credentials and contact us if you suspect unauthorized use or an exposure of personal information.
13. Third-Party Services and Links
Services may rely on hosting, software, communication, payment, or delivery providers. Third-party services may have separate terms and privacy notices. Those arrangements do not eliminate the Company's own legal responsibilities to its customers. A link or brand reference does not itself imply endorsement.
14. Service Management and Availability
We may maintain, update, suspend, or restrict website features for legitimate operational, legal, or security reasons. Availability is not guaranteed. An interruption does not eliminate accrued customer rights, privacy obligations, or obligations relating to paid orders.
15. Term and Termination
These Terms apply while you use the Services. We may restrict access for fraud, unlawful activity, serious security concerns, or a material breach. We may provide notice where appropriate or required.
Termination of an account does not eliminate a refund owed, a protected right, or a record-retention duty. Provisions that by their nature survive termination continue only to the extent permitted by law.
16. Modifications and Corrections
We may revise these Terms and update the date above. Material changes receive additional notice where required. New terms do not retroactively reduce rights applicable to an already accepted order without lawful agreement. Correcting an error does not permit charging an increased price without authorization.
17. Disclaimers
THE WEBSITE AND GENERAL INFORMATIONAL FEATURES ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS, TO THE EXTENT PERMITTED BY LAW. We do not promise uninterrupted access or that informational tools will produce a particular result.
These website disclaimers do not disclaim express product promises, applicable product warranties, or consumer rights that cannot lawfully be excluded. Product descriptions and website disclaimers must be read consistently with applicable law. Information on the Site is not medical or legal advice.
18. Limitation of Liability
TO THE EXTENT PERMITTED BY LAW, THE COMPANY IS NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES ARISING FROM USE OF THE WEBSITE.
Subject to the exclusions below and only where enforceable, the Company's aggregate liability relating to the Services is limited to the lesser of the amount you paid to the Company during the six months before the event giving rise to the claim or US $2,000.
These limitations do not apply to refunds or payment reversals owed under these policies or law; bodily injury or death for which liability cannot lawfully be excluded; fraud, gross negligence, or willful misconduct; nonwaivable privacy or consumer rights; or any other liability that applicable law does not permit us to limit. They do not apply where a limited remedy fails of its essential purpose. Applicable law controls whenever it provides a nonwaivable remedy greater than these limitations.
19. Indemnification
To the extent permitted by law, you are responsible for third-party claims and reasonable resulting costs caused by your unlawful conduct, infringement, or material breach of these Terms. This provision does not require you to indemnify us for our own negligence, wrongful conduct, or legal responsibilities to consumers. It does not penalize an honest review or a good-faith exercise of legal rights.
20. Governing Law
Texas law governs these Terms except where applicable federal law or nonwaivable law of another jurisdiction controls. Nothing in this choice-of-law provision removes mandatory consumer protections available to you.
21. Dispute Resolution and Venue
Subject to mandatory law and any nonwaivable venue rights, proceedings relating to these Terms may be brought in an appropriate state or federal court in Harris County, Texas. The parties consent to jurisdiction there to the extent permitted by law. The Austin mailing address does not represent a different agreement about venue.
You may contact us to attempt informal resolution. Doing so is not a condition to exercising a nonwaivable right, making a protected complaint, disputing a charge, or obtaining emergency relief. These Terms do not shorten an otherwise applicable statutory deadline for bringing a claim and do not impose mandatory arbitration or a class-action waiver.
22. Electronic Communications
We may provide account, security, and transaction information electronically where permitted. Any consent required for electronic records or signatures will be obtained in the manner required by applicable law. Use of the Site does not waive rights that cannot be waived or authorize unrelated marketing communications.
23. California Users and Residents
California consumers retain applicable statutory rights. Consumer assistance is available from the California Department of Consumer Affairs, Consumer Information Center, 1625 North Market Blvd., Suite N 112, Sacramento, CA 95834, telephone 800-952-5210. The California Attorney General also provides an online consumer-complaint process at https://oag.ca.gov/contact/consumer-complaint-against-business-or-company. These resources do not imply that California shipping is available.
24. Miscellaneous
These Terms and the policies expressly incorporated for a transaction form the agreement concerning the Services, subject to mandatory law. If a provision is unenforceable, it is severed or limited only to the extent necessary, and the remainder continues where lawful. Failure to enforce a provision is not a waiver.
No partnership, employment, or agency relationship arises merely from use of the Services. An assignment does not reduce accrued customer rights. No provision is intended to override a law that cannot be waived by contract.
